Terms of Service

1.1 Forty Eight is a bespoke home décor brand. All products are entirely handmade. By placing an order, you acknowledge and accept that you are commissioning a unique, handcrafted work of art, not a mass-produced commodity. 

1.2 The following product categories are offered under the Forty Eight brand: 

      1.2.1 Rugs: Hand-Knotted and Hand-Tufted 

      1.2.2 Candles: Featuring metal, wood, and glass bases 

      1.2.3 Resin Art: Including trays, coasters, table tops, clocks, and wall hangings

      1.2.4 Dhokra Art: Handmade brass metal art crafted by a tribal community from Chhattisgarh, using the ancient lost-wax casting technique 

1.3 Handmade Variation Clause: Due to the inherently artisanal nature of our production processes, which include lost-wax casting for Dhokra Art, hand-pouring for Resin Art, and hand-weaving for Rugs, no two products are or can be identical. Minor variations in colour, texture, dimension, surface finish, and visual pattern are natural characteristics of handmade goods and shall not constitute a defect or ground for return, replacement, or refund. 

1.4 Photography Disclaimer: Product images on our website and social media are for representational purposes only. Actual products may vary slightly in colour tone due to screen calibration, lighting conditions at the time of photography, or natural pigment variation. For Dhokra Art specifically, any terracotta decorative backgrounds or staging elements visible in product photography are for aesthetic purposes only and do not form part of the product sold. The product sold is exclusively the brass metal art piece as described in the listing. 

2.1 All products listed on our platform as 'Customised' or 'Pre-Order' are produced exclusively to your specifications and requirements. By placing such an order, you confirm that you have reviewed and approved all design specifications, including but not limited to dimensions, colour palette, material selection, motif or pattern, and finish. 

2.2 Design Lock-In: Upon confirmation of a Customised or Pre-Order, all design specifications are immediately locked. No amendments to design, size, colour, or material shall be accepted after order confirmation, as raw materials are procured and artisan time is allocated at the point of order. 

2.3 In placing a Customised or Pre-Order, you expressly acknowledge that:

      2.3.1 Raw materials will be sourced and, in the case of Dhokra Art, bespoke brass moulds or models may be prepared. 

      2.3.2 Artisan schedules at independent craft centres, including tribal community workshops in Chhattisgarh, will be reserved on your behalf. 

      2.3.3 The lead times specified under Section 3 of our Shipping Policy represent good-faith estimates and may vary due to the handmade nature of production. 

2.4 Colour Matching for Candles and Resin: Forty Eight will make reasonable commercial efforts to match colour preferences communicated at the time of order. However, due to the nature of resin pigments and candle dyes, exact colour replication from a reference image is not guaranteed. We will always seek your approval for a colour swatch or sample where feasible before production commences. 

3.1 All prices are listed in Indian Rupees (INR) and are inclusive of applicable Shipping charges unless otherwise stated. 

3.2 Full payment is required at the time of order placement for all products, including Customised and Pre-Order items. We do not offer deferred payment or instalment plans unless expressly agreed upon in writing. 

3.3 In the event of a pricing error on our part, we reserve the right to cancel the affected order and issue a full refund. We will notify you promptly in such circumstances. 

4.1 All product designs, photography, brand identity, copy, and visual content associated with Forty Eight are the exclusive intellectual property of Forty Eight and its founding members. 

4.2 You may not reproduce, distribute, sell, or commercially exploit any Forty Eight designs, product images, or branding materials without prior written consent. 

4.3 Bespoke designs created for a customer are made exclusively for that customer's personal use. Forty Eight retains the right to photograph completed products for portfolio and marketing purposes unless the customer expressly requests otherwise at the time of order. 

5.1 Forty Eight shall not be liable for any indirect, incidental, special, or consequential losses or damages arising from the use or inability to use our products, including but not limited to: loss of use, loss of data, loss of revenue, or damage to property. 

5.2 Our total liability to you in connection with any order shall not exceed the price paid by you for that specific order. 

5.3 Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable Indian law. 

6.1 These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Consumer Protection Act, 2019, the Information Technology Act, 2000, and the Sale of Goods Act, 1930. 

6.2 In the event of a dispute, we strongly encourage customers to contact us directly at support@fortyeight.co.in to seek an amicable resolution. 

6.3 If a dispute cannot be resolved amicably within 30 days, the parties agree to submit to the exclusive jurisdiction of the courts of Bareilly, India. 

7.1 Forty Eight reserves the right to amend these Terms at any time. Any amendments shall be posted on our website with a revised effective date. Continued use of our services following such amendments constitutes your acceptance of the updated Terms.
